Finding my own answer (isn't that always the best way)
Scanning the patchreports for fssnap bugs (one should alway rtf docs)
Looks like there were problems with fssnap on x86.
Four primary patches:
110403
110404
110405
108529
and two associated patches:
110380
110402
were needed to make fssnap work.
Looks like a great way for making backups on an active system.
